Alternative Dispute Resolution

Alternative Dispute Resolution (ADR) refers to methods of resolving conflicts or disputes outside of traditional court litigation.ADR aims to provide quicker, more cost-effective, and less formal ways for parties to resolve their disagreements.

ADR methods are often voluntary and involve a neutral third party to assist the process, allowing parties to maintain control over the outcome. There are several common types of ADR with which Kogan Law P.A. can assist:

Mediation

Mediation is a form of alternative dispute resolution (ADR) where a neutral third party, known as the mediator, helps people or groups involved in a conflict to communicate and negotiate a mutually acceptable solution.

The mediator does not make decisions for the parties but facilitates discussions, guides them in exploring their concerns and needs, and helps them find common ground. The mediation process is confidential and enables the parties to agree to creative settlement options that may not otherwise be available through the court process. At times, judges require that the parties attend mediation before a case can proceed to trial. An agreement reached at mediation is enforceable in court.  

Arbitration and Confirmation of Arbitration Awards

Arbitration is a growing and popular method of alternative dispute resolution (ADR) in which a neutral third party, known as an arbitrator, is selected to adjudicate the parties’ dispute outside the standard court process. The arbitrator hears the evidence, reviews the arguments, and makes a binding decision. The arbitrator’s final decision – the award – must be reduced to a judgment in a court of law to be enforceable.
