Contract, Business, General Commercial Disputes

From negotiation to litigation, Kogan Law P.A. can assist you with an array of contract, business, and general commercial disputes. Below are some examples of the type of cases Kogan Law P.A. can assist with:

Contract Disputes

A contract dispute can arise because the parties disagree about the meaning or scope of contract terms, or disagree about each other’s rights and contractual obligations. Kogan Law P.A. will review your contract to ensure that your agreement meets legal standards and protects your interests. Or, if there is an allegation that a contract to which you are a party has been violated, Kogan Law P.A. will help you negotiate a resolution or represent you in court.

Business Disputes

A business dispute can arise among business partners regarding management decisions, partner misconduct, profit distribution, or other governance issues. A business dispute can also arise between businesses in their course of dealing, or with suppliers and customers. In Florida, a business involved in litigation must be represented by an attorney, and Kogan Law P.A. will work diligently to protect your interest in and out of the courtroom.

Fraud

Fraud can arise if you have been misled into taking certain action, such as signing a contract, loaning money, or entering into a business transaction. You can be misled by others if they made false statements, omitted or concealed important information, or fabricated documents. In certain cases, if you have been a victim of unconscionable, unfair, or deceptive acts or practices, you may also have a claim under Florida’s Unfair and Deceptive Trade Practices Act. If you believe you’ve been defrauded, contact Kogan Law P.A. for a case evaluation.

Civil Theft

Florida law provides a legal, civil remedy for those harmed by theft. Unlike criminal theft, which is prosecuted by the state and involves criminal penalties, civil theft is pursued through a civil lawsuit where the harmed party seeks financial compensation. If someone has unlawfully taken your property or assets without your permission, Kogan Law P.A. can help you file a case for three times the value of your stolen property.

Worthless Check

A bad check, in a civil context, is a check that is returned unpaid because the account it is drawn on does not have enough funds to cover the amount of the check. This also includes situations where the account has been closed, or where the maker stops payment with intent to defraud. If you receive a bad check, contact Kogan Law P.A. to pursue a civil claim against the issuer of the bad check for the face amount of the check plus additional damages.

Equitable claims and remedies

Your dispute may not always fit into a traditional legal cause action because you don’t have a written document or perhaps there is no Florida Statute addressing your legal issue. In those instances, your dispute may be governed by common law claims that are based on principles of fairness. Kogan Law P.A. can help analyze your legal issues to determine which course of action can address the harm you have suffered.
