Debt Collection & Judgement Execution

Kogan Law P.A. represents both individuals and businesses in the collection of consumer and commercial debt. Kogan Law P.A.’s services range from pre-suit negotiations, to litigation, to post judgment execution. Unlike with volume firms or debt collection agencies, your debt and judgment will get personalized attention and a creative strategy for better results.

Debt Collection

Debt can be any financial obligation where the debtor is required to repay a sum of money. Debt can stem from a loan, an unpaid invoice, or money owed for goods or services. If someone owes you money, Kogan Law P.A. can help you pursue collection in a cost-effective way.

Post-Judgment Execution

A Judgment is a final ruling from a court of law that a sum of money is owed. However, there is no “debtor’s prison” in Florida, and the debtor can simply choose not to pay the amount awarded, leaving you to seek collection through the court process. Kogan Law P.A. works with private and financial investigators, and employs various post judgment collection techniques, to fight for your recovery.

  • Garnishment of wages, bank and investment accounts, and other assets held for the benefit of the debtor;
  • Imposition of liens on real and personal property
  • Sheriff seizure of boats, vehicles, and other personal property
  • Sheriff seizure of non-exempt real property
  • Proceedings against corporate interest
  • Financial discovery and enforcement

Proceedings Supplementary and Impleader

It is not uncommon for a judgment debtor to avoid collection by transferring its assets and properties to friends and family members, or “selling it” for little to no value. Fortunately, the law allows us to undo these transfers to help you collect your judgment. The attorneys at Kogan Law P.A. are experienced in the substantive and procedural steps that need to be taken to accomplish this goal, and are ready to assist you.

Judgment Renewal

The life of a money judgment in the State of Florida is 20 years. However, if you have been unable to collect your judgment in that span of time, Florida law permits you to renew your judgment for an additional 20 years. If you hold an unsatisfied money judgment  in the State of Florida, and wish to extend the life of that judgment, Kogan Law P.A. can help.

Foreign Judgment Domestication

If you hold a judgment from another state, or another country, but your debtor resides in Florida, the law allows you to register your judgment in Florida and pursue collection without the need of re-litigating your case. Kogan Law P.A. regularly works with attorneys and clients from other U. S. states and foreign countries to help them collect their judgments here in Florida.

Pre-Suit Assessment of Collectability

The decision to sue someone is not an easy one, and you must be ready to devote time, money, and often times, mental and emotional energy into your lawsuit. And, while you evaluate the potential of winning your lawsuit, you should equally evaluate the potential of collecting against your Defendant. Kogan Law P.A. can assist you with making a preliminary assessment of the Defendant’s collectability. This can be instrumental to your cost-benefit analysis of filing suit, and to any future settlement decisions.
