Judgement & Collection Defense

Extraordinary Remedies and Judgment Defense

If a Final Judgment has been entered against you, Kogan Law P.A. can review your case and analyze whether the judgment was properly entered against you, or whether there are grounds upon which the entry of the judgment can, or should be, reversed. Before the court can award a final judgment, there must be proper service of process, and certain award of damages require an evidentiary proceeding.

In limited cases, there may be grounds upon which you can ask for reversal of the judgment due to change in circumstances in the case, or fraud. However, you have limited time to request this type of relief, and should therefore seek a consultation immediately upon learning of the judgment. The attorneys at Kogan Law P.A. have successfully challenged judgments for their clients and can evaluate whether the final judgment against you can be challenged.

Collection Defense

If a valid final judgment has been entered against you, the Judgment holder can take a variety of steps to discover your financial information, and go after your assets. However, not all assets are collectable, and you may be entitled to various protections and exemptions. Kogan Law P.A. will work diligently to protect your exempt assets from collection, and will fight to make sure that judgment holders stay within the appropriate scope of financial discovery.

Impleader Defense

Impleader proceedings refer to a legal process in which a judgment holder in a lawsuit brings a third party into the case, seeking to hold that third party accountable for its judgment. If you are being sued to be held accountable for the debt of another, you should contact a lawyer immediately. Impleader proceedings follow a very short timeline and your assets and property can be at risk. Kogan Law P.A. is ready to protect your rights and your property.
